DECISION

To establish the Center for Doping and Medical Sport

under the General Department of Sports and Physical Training,

Ministry of Culture, Sports and Tourism

THE PRIME MINISTER

Pursuant to the Law on Organization of Government dated December 25, 2001;

Pursuant to Decree No. 178/2007/ND-CP dated December 03, 2007 by the Government, defining the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 185/2007/ND-CP dated December 25, 2007 by the Government, defining the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the request of the Minister of Culture, Sports and Tourism,

DECIDES

Article 1: To establish the Center for Doping and Medical Sport under the General Department of Sports and Physical Training.

The Doping and Sports Medicine Center is a state administrative unit, functioning in researching, testing, preventing doping in sports and physical training; diagnosing and treating diseases, rehabilitating for athletes and individuals participating in sports and physical training related to the use of doping.

The Center for Doping and Medical Sport, based in Hanoi, is entitled to legal status, seal and account in accordance with the laws.

Article 2: The Director of the General Department of Sports and Physical Training defines specifically functions, tasks, powers, and organizational structure of the Center for Doping and Sports Medicine.

Article 3: This Decision takes effect from the date of its signing.

The Ministers, the Heads of Ministerial-level agencies, the Heads of Governmental agencies, and the Director of the General Department of Sports and Physical Training are responsible for the implementation of this Decision./.

the Center for Doping and Medical Sport

THE GENERAL DEPARTMENT OF SPORTS AND PHYSICAL TRAINING

Pursuant to Decree No. 185/2007/ND-CP dated December 25, 2007 by the Government, defining functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decision No. 66/2008/QD-TTg dated May 23, 2008 of the Prime Minister, defining functions, tasks, powers, and organizational structure of the General Department of Sports and Physical Training of the Ministry of Culture, Sports and Tourism;

Pursuant to Decision No. 2469/QD-TTg dated December 28, 2011 of the Prime Minister regarding the establishment of the Center for Doping and Medical Sport under General Department of Sports and Physical Training, the Ministry of Culture, Sports and Tourism’s;

At the request of the Director of the Center for Doping and Medical Sport and of the Head of the Organization and Personnel Department,

DECIDES

Article 1: Status and functions

The Center for Doping and Medical Sport is a state administrative unit under the General Department of Sports and Physical Training, capable of doping research, test, and prevention in sports and physical training; providing medical exam, treatment, and rehabilitation for sportsmen and those participating in sport and physical training activities related to the use of doping.

The Center for Doping and Medical Sport is entitled to legal status, seal and account in at the State Treasury and bank,

Article 2: Duties and powers

1.To submit to the Director General of the General Department of Sports and Physical Training the development planning of the long-term, 5-year, and annual programs of the Center and to organize the due implementation upon approval.

2.To submit to the Director General of the General Department of Sports and Physical Training the Anti-Doping plan and program; to implement anti-doping tasks preventing the use of doping in sport activities at tournaments both domestic and international.

3.To advise leaders of the General Department on the guide for the implementation of Anti-Doping Regulations; to study measures preventing the employment of performance-enhancing substances and prohibited methods in activities of sport and physical training.

4.To perform test and verify results of doping-test samples upon request; to archive doping-test samples and results in activities of sport and physical training in accordance with the laws.

5.To provide medical exam, treatment, and rehabilitation for sportsmen and those participating in activities of sport and physical training in accordance with the laws.

6.To study application of science and technology in areas of doping prevention and control and medical sport; to study nutrition in sports; to test and evaluate the effects of drugs, foods, functional foods, and drinking water used in sport training and contest.

7.To form joint venture with organizations and individuals both domestic and foreign in conducting scientific research, technology development, medical exam and treatment, and professional training in doping prevention/control and medical sport.

8.To inform, educate and raise awareness regarding prevention and control of performance-enhancing drugs and prohibited methods in activities of sport and physical training.

9.To provide services conforming to duties and functions vested in accordance with the law.

10.To organize the management of the apparatus, human resources and documentations; implementing the policies and entitlements for officials, officers and employers under the scope of management as delegated by the Director General of the General Department of Physical Training and Sports in accordance with the law.

11.To manage and use finances, assets and other incomes in accordance with the law.

12.To perform other tasks assigned by the Director General of the General Department of Physical Training and Sports.

Article 3: Organizational structure

1.Director and Deputy Directors

2.Departments:

a.The Department of Personnel and Administration

b.The Department of Accounting

c.The Department of Medical Sport

d.The Department of Doping and Bio Technology

e.The Department of Medical Exam, Treatment and Rehabilitation

f.Ho Chi Minh City branch

3.The Director of the Center for Doping and Medical Sport defines duties and powers of the functional departments; arranges staff upon the structure of job titles and professional standards; and issues working rules of the Center.

Article 4: Effective Implementation

This Decision takes effect upon the date of signing.

Article 5: Implementation Responsibility

The Director of the Center for Doping and Medical Sport, the Chief of Staff, the Head of the Personnel Department, the Head of the Finance Department, heads of other Departments, agencies of the General Department of Physical Training and Sports, and relevant organizations and individuals are responsible for the implementation of this Decision./.
